1. Acceptance of Terms

By accessing or using any service provided by StarterHost ("we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use our services. These terms apply to all users including visitors, customers, and anyone who accesses our platform.

    Important: These terms constitute a legally binding agreement between you and StarterHost. Please read them carefully before purchasing or using any of our services.

2. Eligibility

You must be at least 18 years of age to use our services. By using StarterHost, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement. If you are using our services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.

3. Account Registration

To use our hosting services, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Keep your account password confidential and not share it with anyone
Notify us immediately of any unauthorised use of your account
Take full responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these terms.

4. Acceptable Use Policy

You agree not to use our services to host, store, transmit, or distribute any content or engage in any activity that:

Violates any applicable Indian or international law or regulation
Infringes any intellectual property rights of others
Contains viruses, malware, ransomware, or other harmful code
Sends unsolicited bulk email (spam) or conducts phishing activities
Hosts illegal content including but not limited to child exploitation material
Facilitates illegal gambling, drug trafficking, or financial fraud
Consumes excessive server resources that affect other customers (resource abuse)
Attempts to gain unauthorised access to any system or network

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

5. Payment & Billing

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. By purchasing a plan, you authorise us to charge your chosen payment method via PayU.

Hosting plans are billed on a monthly recurring basis
Payments are due on your renewal date each month
Failed payments may result in service suspension after a 3-day grace period
We reserve the right to change pricing with 30 days advance notice

6. Service Availability & Uptime

We strive to maintain 99.9% uptime for all hosting services. Scheduled maintenance will be announced in advance. In the event of unplanned downtime exceeding our SLA, you may be eligible for service credits as per our uptime guarantee policy. Service credits are the sole remedy for downtime and do not constitute grounds for a refund.

7. Data & Backups

While we provide daily automated backups on eligible plans, you are ultimately responsible for maintaining your own backups. We are not liable for data loss resulting from hardware failure, accidental deletion, or any other cause. We strongly recommend maintaining independent backups of all your website data.

8. Intellectual Property

All content on the StarterHost website, including logos, text, graphics, and software, is the property of StarterHost and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Suspension & Termination

We reserve the right to suspend or terminate your account at any time for:

Violation of these Terms of Use or our Acceptable Use Policy
Non-payment of dues
Fraudulent or illegal activity
Any activity that threatens the security or integrity of our platform

Upon termination, your data will be retained for 90 days before permanent deletion. You may request an export of your data within this period.

10. Limitation of Liability

To the maximum extent permitted by applicable law, StarterHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless StarterHost, its directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising out of your use of our services, your violation of these terms, or your violation of any third-party rights.

12. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or a notice on our website at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the updated terms.
